Basil is former lead partner of Jackson McDonald’s Projects, Infrastructure & Construction Law team. For over 30 years he has practised in the areas of contracting law relating to major projects and infrastructure, insurance, commercial litigation, Occupational Safety & Health and general legal services.
Basil has supported numerous clients in connection with dispute resolution by guiding matters in the Supreme Court, District Court, arbitrations, expert determinations, adjudications and mediation concerning defective workmanship, contribution and indemnity claims in tort, standard form building and engineering contracts involving, inter alia, variations, extensions of time, liquidated damages and damages for delay etc.
Basil has assisted local and multinational clients with all forms of contracts, including building contracts, project management contracts, consultancy contracts, contracts for the supply of goods and services, contracts for the purchase of goods and services, developing full suites of contracts for major contractors (including 2 of WA’s major PPP projects), FPSOs (Floating Production Storage Offloading platform) and assisting with the contracts relating to several power stations.
Basil has advised a number of multinationals involved in the resource industry (supplying the mining industry with products and services), the energy (oil, gas and coal) sector and construction and engineering industries in connection with their Western Australian operations including major contractors based in France, Italy, Japan, Malaysia, Norway, Singapore, the UK and the US.
Recent Experience
Provided legal support for and advised on contract negotiation and drafting relating to the construction of several power stations;
Attended on the suite of contracts relating to the operation of a FPSO(Floating Production Storage Offloading platform);
Managed a multi-million dollar dispute for an international contractor concerning large cost blow out on a major infrastructure project;
Conducted multi-million dollar disputes for an international client arising out of the construction of a power station;
Participated in the legal work group that prepared the reference model for the Alliancing Association of Australasia Alliance Development Proposal Agreement and Project Alliance Agreement;
Advised an insurer in relation to the failure of pipework at a construction site after installation, which has affected the use of the works, where potential responsibility for the problems ranged from defective specification, use, design, construction or materials;
Advised various firms of architects and contractors at various times in relation to insurance policies in the context of insurance clauses in contracts engaging them and their policies;
Advised owners in relation to insurance provisions contained in contracts for the construction of buildings and development of mines.
